What expungement means

Expungement is a court process that removes eligible arrests, charges, and convictions from the background checks employers and landlords run. New Jersey sets the rules in statute, including who qualifies and how long they must wait.

Those rules changed significantly under the 2019 Clean Slate law. Waiting periods are shorter and a ten-year whole-record option now exists, so many people who were once told no are eligible today.

New Jersey's Clean Slate law

Clean Slate is a New Jersey law, in effect since 2020, that lets many people clear their entire record at once instead of one case at a time. If ten years have passed since your most recent conviction, sentence, or fine, with no new convictions, most or all of your record may be eligible in a single petition, including cases that were once considered too numerous to expunge.

Clean Slate does not cover every offense; the most serious crimes are excluded, and the ten-year clock has specific rules about when it starts.
